Terms of Service — The Magnetpreneur™

Welcome to The Magnetpreneur™ (“Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, content, digital products, physical products, and services available through themagnetpreneur.com and any associated platforms (collectively, the “Site”).

By accessing or using the Site, making a purchase, downloading content, or interacting with us, you acknowledge that you have read, understood, and agree to be bound by:

  • these Terms
  • our Refund Policy
  • our Privacy Policy
  • any additional product-specific terms listed on product pages

If you do not agree, you must discontinue use immediately.

1. Definitions

For these Terms:

  • “Digital Products” – templates, downloads, guides, checklists, e-books, training, and non-physical items.
  • “Physical Products” – Magnet Maker Machines, accessories, tools, and supplies.
  • “Content” – text, graphics, images, videos, downloads, and materials on the Site.
  • “User,” “Customer,” or “You” – any person who visits or interacts with the Site or purchases from us.

2. Eligibility

To use the Site or make a purchase, you must:

  • be at least 18 years old,
  • have the legal capacity to enter into a contract,
  • provide accurate and truthful information.

If you purchase on behalf of a business, you confirm you are authorized to do so.

We reserve the right to refuse or cancel orders if misuse, fraud, or policy violations are suspected.

3. Accounts and Security

Some features may require an account.

You agree to:

  • keep login details confidential,
  • not share your account with others,
  • notify us immediately of suspicious activity.

We are not responsible for losses arising from unauthorized account usage.

We may suspend or terminate any account violating these Terms.

4. Pricing, Payments & Taxes

All prices are listed in CAD unless otherwise stated.

By placing an order, you confirm that:

  • you are authorized to use the chosen payment method,
  • information provided is accurate,
  • you have reviewed the applicable product details and refund policy.

Prices may change at any time without notice.

Applicable taxes, duties, customs, and import fees (where applicable) are the customer’s responsibility unless otherwise specified.

We reserve the right to:

  • cancel orders due to availability issues,
  • correct honest pricing errors,
  • limit quantities,
  • refuse suspicious transactions.

If we cancel an order prior to shipment, any payment for undelivered items will be refunded.

5. Shipping & Delivery (Physical Products)

Estimated delivery timelines are approximate and not guaranteed.

Once an order ships, risk of loss transfers to the customer.

We are not responsible for delays caused by:

  • carriers,
  • customs inspections,
  • weather or uncontrollable events.

Customers are responsible for:

  • providing accurate shipping information,
  • tracking orders,
  • retrieving packages promptly.

Returned shipments due to incorrect addresses or refused deliveries may require additional reshipping & processing fees.

Damaged or incorrect orders must be reported promptly in accordance with our Refund Policy.

6. Digital Products — License & Access

When you purchase a digital product, you receive a limited, non-exclusive, non-transferable license for personal business use.

You may:

  • download and use files for your own business,
  • customize templates for your own branding.

You may not:

  • resell, share, gift, upload, or distribute files,
  • claim content as your own,
  • include our files inside your own templates, courses, or products,
  • allow others to access files through your account.

Violation may result in revoked access without refund and potential legal action.

7. Refunds, Returns & Cancellations

Our Refund Policy forms part of these Terms and applies to all purchases.

Key reminders:

  • digital products are final sale,
  • Magnet Maker Machines are final sale (except warranty-related cases),
  • cancellations may not be possible once processing begins.

Chargebacks filed without contacting us first may delay resolution.

8. Warranty — Magnet Maker Machines

All Magnet Maker Machines are final sale. Returns and exchanges are not accepted once an order is placed.

However, your purchase is protected with the following warranties:

1-Year Manufacturer Warranty (Defects Only)

For 12 months from the delivery date, your machine is covered for manufacturing defects only.

A manufacturing defect means the issue existed when the machine was produced.

Not covered:

  • misuse or improper setup,
  • failure to follow instructions,
  • accidental damage, drops, or spills.
  • damage from unauthorized repairs or modifications,
  • cosmetic issues that do not affect performance,
  • wear and tear from regular use,
  • issues caused by using non-approved parts or accessories.

If a covered defect is confirmed, the solution may include:

  • repair,
  • replacement parts,
  • or replacement of the unit.

The appropriate solution is determined at our discretion.

Lifetime Parts Support (Our Commitment to You)

After the first year, we continue supporting your machine.

If a covered part fails due to normal use, we will provide the replacement part at no cost.

You are responsible for:

  • shipping fees,
  • installation or service fees (if needed).

This lifetime coverage does not apply to:

  • consumables (screws, adhesives, trim, etc.),
  • accidental or physical damage,
  • negligence, misuse, or improper operation,
  • altered, opened, or modified machines.

Warranty Process

To submit a claim, you must contact us first.

We may require:

  • your order number,
  • a description of the issue,
  • clear photos/videos,
  • reasonable troubleshooting steps.

We reserve the right to determine whether an issue is:

  • a covered defect,
  • normal wear and tear,
  • user-caused damage,
  • or unrelated to manufacturing.

If the issue is not covered, repair options may be offered at additional cost.

9. Educational & Success Disclaimer

Our training, resources, and content are educational only.

We do not guarantee:

  • results,
  • business growth,
  • income or profit.

Results depend on each customer’s effort, skills, and market conditions.

You are responsible for complying with applicable business, tax, and legal requirements in your region.

10. User Content (Reviews, Comments, Messages)

By submitting content (reviews, testimonials, messages, photos), you grant us a worldwide, royalty-free license to:

  • use,
  • publish,
  • display,
  • and reproduce

such content for marketing and improvement purposes.

You agree not to submit illegal, harmful, defamatory, or misleading content.

We reserve the right to remove content at our discretion.

11. Prohibited Uses

You agree not to use the Site:

  • for unlawful or fraudulent activity,
  • to harm or harass others,
  • to copy, scrape, hack, or reverse engineer the Site,
  • to upload viruses or malicious code,
  • to infringe trademarks, copyrights, or privacy rights.

Violation may result in termination and potential legal action.

12. Intellectual Property

All Site content is owned by or licensed to The Magnetpreneur™.

You may not:

  • copy or reproduce materials,
  • redistribute our digital or physical content,
  • use brand names, trademarks, or product images without permission.

“The Magnetpreneur™” is a protected brand identity.

13. Third-Party Services & Links

We may link to or integrate with third-party platforms.

We are not responsible for:

  • external content,
  • privacy practices,
  • service performance or damages caused by third parties.

Use third-party services at your own risk.

14. Product Use, Safety & Customer Responsibility

Our Magnet Maker Machines, die-cut cutters, tools, and supplies must be used with care and only for their intended purpose.

By purchasing and using our Physical Products, you agree to:

  • read and follow all instructions, guides, warnings, and safety information provided;
  • use the products only as intended;
  • keep machines, cutters, tools, and small parts away from children and pets;
  • use proper care when handling sharp tools, cutters, heated parts, moving parts, or heavy equipment;
  • ensure the product is placed on a stable and safe surface before use;
  • stop using the product immediately if it appears damaged, unsafe, or not working properly;
  • contact us before attempting repairs, adjustments, or modifications.

You are responsible for any damage, injury, loss, or accident caused by:

  • misuse;
  • improper setup;
  • unsafe handling;
  • failure to follow instructions;
  • use by children or unsupervised individuals;
  • unauthorized repairs or modifications;
  • use with non-approved parts, tools, or accessories;
  • using the product for purposes other than its intended use.

To the fullest extent permitted by law, The Magnetpreneur™ is not responsible for damages, injuries, losses, or accidents caused by misuse, improper operation, unauthorized modifications, or failure to follow product instructions.

14a. Limitation of Liability

To the fullest extent permitted by law, The Magnetpreneur™ is not liable for:

  • indirect or consequential damages;
  • lost profits or business interruption;
  • data loss;
  • product misuse, improper setup, or unsafe handling;
  • damages caused by failure to follow product instructions;
  • unauthorized repairs, modifications, or use with non-approved parts.

Our total liability shall not exceed the purchase price of the product giving rise to the claim.

Certain jurisdictions do not allow exclusions — where required, our liability will be limited to the minimum extent allowed by law.

Nothing in these Terms is intended to exclude or limit any rights that cannot legally be excluded under applicable consumer protection laws.

15. Indemnification

You agree to indemnify and hold harmless The Magnetpreneur™, its owners, partners, and employees from any claim or loss arising out of:

  • your misuse of our Site or products,
  • violation of these Terms,
  • infringement of third-party rights.

16. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law rules. Where applicable, disputes will be resolved in Quebec courts.

17. Termination

We may suspend or terminate site access or product privileges if:

  • Terms are violated,
  • fraud or abuse occurs,
  • illegal activity is suspected.

Termination does not cancel obligations incurred prior to termination.

18. Force Majeure

We are not responsible for delays or failures caused by events outside our control, including:

  • natural disasters,
  • shipping interruptions,
  • government actions,
  • network outages,
  • labor disputes.

19. Severability

If any provision of these Terms is found invalid, remaining provisions remain enforceable.

20. Entire Agreement

These Terms, together with our policies, constitute the entire agreement between you and The Magnetpreneur™.

21. Changes to Terms

We may update these Terms occasionally. Continued use of the Site after updates constitutes acceptance of the revised Terms.
